POPIA Disclaimer

  1. This Protection of Personal Information Act 4 of 2013 (POPIA) Disclaimer describes how the ECDSD collects, processes, and discloses your personal information. This disclaimer applies to all persons (both natural and juristic, including companies, close corporations and trusts) whose personal information we collect, regardless of form and medium. This includes our clients, members of the public, employees, consultants, agents and service providers.
  2. This disclaimer applies to all our services, both core services and non-core services and related website.
  3. At ECDSD we respect your right to privacy and aim to comply with POPIA. By accessing this website, and by accessing our services, you consent to the ECDSD and its appointed service providers recording and processing your personal information for its lawful intended purpose. You hereby acknowledge that you accept the terms of this POPIA Disclaimer.
  4. For the purposes of this Disclaimer, personal information shall bear the same meaning as defined in POPIA.

Processing your personal information

  1. You consent to us collecting and processing your personal information, including the personal information of any minor child so that we may:
  2. - Render any such services in accordance with our constitutional mandate and to the extent allowed by applicable sector specific legislation including but not limited to foster care court orders, adoption proceedings, court proceedings and so forth.
  3. - Assess and consider applications by any NPO/NGO or third party for funding purposes;
  4. - Process, validate and verify information relating to the procurement of goods and services in terms of any tender or request for quotation;
  5. - To consider applications received in response to vacancies and / or bursary advertisements;
  6. - For the fulfilment of any contractual or legal obligation;
  7. - To alert law enforcement, government officials or other third parties when the ECDSD reasonably believes that the disclosure of personal information is necessary to prevent physical harm or financial loss or to report suspected illegal activity;
  8. - To allow our contracted service providers, who assist us with our business operations, to perform their contractual obligations;
  9. - To compile non-personal and/or personal statistical information for research purposes;
  10. - For any other reason necessary to continue providing you with any other services.
  11. - Your personal information will only be shared to the extent that it is necessary to comply with applicable law or with legal process served on the ECDSD.
  12. - We will ensure that your personal information is only retained for as long as it is necessary to perform our obligations or as long as it is required by the law. You may also consent to us retaining such information for a longer period than required.

Your rights

As the information owner you have the right to:


  1. Inquire about what personal information the ECDSD holds relating to you;
  2. Request for a correction or to update your personal information;
  3. Object to the processing of your personal information (subject to legislation); and
  4. Request the return or destruction of personal information (subject to legislation).
  5. Your rights in this regard may be exercised by contacting the Head of Department in writing at Mzimkhulu.Machemba@ecdsd.gov.za
  6. You further have the right to lodge a complaint with the Information Regulator if you believe we are interfering with the protection of your personal information.
  7. The ECDSD’s PAIA Manual, the PAIA Section 15 Notice and the Information Regulator Guide is available on this website.
  8. The Department has taken all reasonable steps to provide the above documents in hard copy at the reception areas of the Office of the Head of Department, all Area Offices and all Local Service Offices. Where such a document is not immediately available for your personal perusal, the office in question shall be able to provide you with an electronic copy upon request.

Limitation of liability

  1. While we take all reasonable measures and precautions in protecting your personal information, the ECDSD will not be held liable for any loss or damage, howsoever arising, suffered as a result of the disclosure of your personal information, if the harm suffered is outside of our reasonable control.
